How it Works

1 Click on” MY E-CONTRACTS” at the top of the page

2 Click on ‘NEW’ at the top of the page

3 Starting with the VESSEL NAME, proceed to complete details.

4 SAVE “YOUR” WORK. Continuously save your work. If you need to pause work for any amount of time – whether a few hours or a couple of days, the Contract will be saved under the Name of that Vessel, so it is compulsory you fill that field in straight away.
Make sure to click SAVE or SAVE & DOWNLOAD PDF.

5 The Downloaded PDF is the Draft Contract. Please make sure to send a copy of the Draft Contract to the CA for approval before generating the E-Contract for Signatures.

6 DATED. When you generate a Draft contract it should have that date on it. When you generate the actual E-Contract, it should have that date on it.

7 CURRENCY. Do not forget to select either Euro or Dollars.

8 ADDITIONAL FEES: Specify and bullet point if possible. E.g., Bahamas Tax 4%; Delivery Fee; APA; Security Deposit.

9 TOTAL FEES: Should be a total of Charter and all obligatory Additional Fees for the Charter. Make sure it is clear how you arrived at the TOTAL amount.

10 SIGNATURE. Request the full name of each signatory. Send first to the Charterer for Signature; then the Broker must sign before sending to the CA for completion by Owner and Stakeholder.

11 SPECIAL CONDITIONS.
* Make sure you have the Special Conditions as given out by the CA specific to the yacht named in this Contract.
* Then add any of your own and the Charterers’ Special Conditions (if these have been agreed with the CA and Owner).

12 SPECIAL CONDITIONS. If this Charter is not ‘inclusive’ as per page 3, Clause 2 of this Contract, please specify what is ‘not included in the charter fee at the top of the SPECIAL CONDITIONS.

For example: ‘Contrary to Clause 2 of this Charter Agreement, all alcoholic beverages will be charged, at cost and with receipts, to the Charterer. This must be paid for by the end of day one of the charter’.

Or ‘Contrary to Clause 2 of this Charter Agreement, the Charter Fee covers the cost of the yacht, it’s crew and it’s insurance only. All provisions, fuel, dockage, communications and other costs associated with this Charter will be covered by an APA (Advanced Provisioning Allowance) of 30%. All expenses will be accounted for by the Captain and any funds remaining unaccounted for in the APA at the end of the Charter will be returned to the Charterer’.

13 ADDENDUMS. When should I use an Addendum rather than the Special Conditions? An Addendum should be made for any potential outstanding circumstances known at the time of ‘going to contract’: These could include Hurricane Season; Covid-19 Protocols of which travel restrictions could affect the Charter.

13.a ADDENDUMS may also be made any time after the Charter is booked and Charter Agreement fully executed so long as all parties agree to the Terms of the Addendum.
